Gauhati High Court Panel Probes Grounds for Banning Insurgent Network Under UAPA, Demands Swift Rebuttal from Group and Affiliates
In a decisive step to dismantle persistent threats to regional stability, the Unlawful Activities (Prevention) Tribunal at the Gauhati High Court has served a formal show-cause notice to the National Socialist Council of Nagaland (Khaplang) [NSCN (K)] and its entire ecosystem of factions, wings, and front entities. The directive questions why the outfit should not be officially branded an unlawful association under the stringent Unlawful Activities (Prevention) Act (UAPA) of 1967, amplifying the Central government’s crackdown on Northeast insurgencies.
Presided over by Justice Nelson Sailo of the Gauhati High Court, the tribunal was empaneled by the Union Home Ministry to scrutinize evidence and ascertain if compelling justification exists for the ban. The panel expressed initial satisfaction with the case in Nagaland, extending its reach to Manipur and Arunachal Pradesh—hotspots of the group’s shadowy influence. Representing the Union of India was Special Counsel Subhash Chandra Keyal, while Arunachal Pradesh fielded Senior Government Advocate Arun Chandran, ensuring a robust legal showdown.
The notice mandates multi-channel delivery: registered mail, widespread newspaper ads, public announcements, and broadcasts on All India Radio, targeting the elusive network across Nagaland, Manipur, and Arunachal Pradesh. NSCN (K) and its offshoots have 30 days from receipt to submit counterarguments or detailed affidavits, with the next court session slated for mid-December at the Gauhati High Court.
This escalation follows the Home Ministry’s blanket declaration of the group as unlawful, effective immediately, citing its role in fueling unrest and undermining security. The tribunal’s intervention aligns with a broader federal strategy to neutralize extremist holdouts, blending judicial oversight with enforcement to foster lasting peace in the Northeast’s sensitive corridors.
