Gauhati High Court Approves Assam Government’s Plan to Award Land Ownership to Tea Garden Workers

In a landmark ruling, the Gauhati High Court has given the green light to the Assam government’s initiative to provide land ownership rights to tea estate laborers, refusing to halt an amended legislation contested by the Indian Tea Association (ITA). The decision paves the way for long-overdue recognition of workers’ rights in the state’s vast tea plantations.

The case was argued before the court, where the ITA raised concerns that the changes could alter the operational framework of tea gardens, potentially disrupting production and estate management. Representing the state, Advocate General Devajit Saikia countered these claims, emphasizing the welfare-oriented nature of the policy. The court ultimately sided with the government, viewing the move as a legitimate step toward social equity without issuing any interim stay.

Under the new provisions, tea workers living in designated labor lines within estates can secure ownership by paying a nominal fee of Rs 500 per bigha. Assam boasts around 850 tea estates, with labor lines present in 707 of them. For generations, these workers have resided on the land without any formal rights, a situation the government aims to rectify through this reform.

The policy stems from a cabinet approval, followed by the enactment of the Assam Fixation of Ceiling of Land Holdings (Amendment) Act, 2025, by the state Assembly. This legislation specifically facilitates the allocation of housing land in labor quarters to eligible families.

Chief Minister Himanta Biswa Sarma hailed the amendment as a rectification of a “long-standing historical oversight,” honoring the contributions of tea workers who have labored in Assam’s gardens for over two centuries, many tracing their roots to colonial-era migrations.

This judicial endorsement is expected to empower thousands of families, enhancing their security and economic stability while addressing deep-rooted inequalities in the tea industry.
